Matt Smith Canine Training Terms & Conditions

Dogs are living creatures, and their behaviours naturally change over time due to factors such as age and changes in their environment and diet. Any guarantee in these Terms and Conditions cannot circumvent these factors.

Definitions

​

  1. Agreement means the quotation, acceptance and the following terms and conditions.

  2. Booking means the creation of agreement between Matt Smith Canine Training and the Client.

  3. Work or works means Home Assessment, Practical Training Sessions, handouts, written report, training program created by Matt Smith Canine Training. It may also describe other services such as administrative, training meetings and other tasks which are necessary in the creation of the Phased Training program.

  4. The Client means the individual who requested the work.

  5. Amendments means any alteration to the work.

 

Entire Agreement

 

  1. Ordering services or using work created by Matt Smith Canine Training is automatically agreeing to these terms and conditions.

  2. These terms and conditions apply to all sales and services by Matt Smith Canine Training, to the exclusion of any other terms unless otherwise agreed in writing.

  3. Matt Smith Canine Training reserves the right to update these Terms and Conditions at any time with notice and with immediate effect.

  4. These terms and conditions shall prevail over all terms and conditions of your customary practice or any previous course of dealings the client has had with Matt Smith Canine Training.

  5. These terms and conditions apply to all work created by Matt Smith Canine Training. Work services or products are only supplied in strict accordance with these terms and conditions.

  6. These terms and conditions shall be subject to English Law.

  7. The contents contained in the quotation (verbal or written) and these Terms and Conditions form the agreement between Matt Smith Canine Training and the Client relating to the work, no variation on them will be binding to Matt Smith Canine Training unless it is agreed in writing and signed by Matt Smith Canine Training.

  8. Each clause of this Agreement is independent and operates separately in its own right.

  9. By agreeing to these terms and conditions your statutory rights are not affected.

  10. Should Matt Smith Canine Training decide to waive any of these terms on an individual basis, this shall not affect the validity of remaining clauses or commit Matt Smith Canine Training to waive the same clause on any other occasion.

  11. Any alterations or variations of these terms and conditions shall be inapplicable unless agreed in writing by all parties concerned before commencement of any work.

  12. This contract shall be governed by the laws of England and both parties shall submit to the non-exclusive jurisdiction of the English courts.

 

Guarantee

 

  1. Matt Smith Canine Training shall create the agreed work for the use of the client. The client may use the work or works only in its original form and only for its original use for the animal named and described within the work.

  2. Canine training work cannot be guaranteed.

  3. Matt Smith Canine Training shall create a training programme to the specifications of the problems assessed at the Home Assessment and will make amendments to the training programme accordingly.

  4. The training programme is specific to the dog(s) that the programme has been designed for and should not be used in part or whole with any third party.

  5. The client shall agree not to sell, destroy, deface, alter, or part with work created by Matt Smith Canine Training or permit it to be given or done so by any third party.

 

General Terms & Booking

​

  1. Upon booking confirmation, the client agrees to all terms and conditions.

  2. Matt Smith Canine Behaviour Training reserve the right to record visually during any session without prior notice or consent, for professional evaluation, progress, and technique monitoring. Matt Smith Canine Training shall seek permission to upload any images or video to any social networking platform.

  3. All bookings must be confirmed upon creation. Bookings not confirmed less than 24 hours prior to booking will be cancelled, any payment will be retained by Matt Smith Canine Training.

  4. A Home Assessment or evaluation must be carried out prior to any further services.

  5. Work created by Matt Smith Canine Training is charged to the client at the agreed amount.

  6. The full charge of the service is payable at the Home Assessment and/or training session.

  7. Deadlines set in the agreement will not affect Matt Smith Canine Training’s right to be paid.

  8. If work is cancelled the client shall reimburse Matt Smith Canine Training for all losses arising. 

  9. All work created by Matt Smith Canine Training for the client is to be used for the sole purpose for which it was created. The client does not have the right to resell work created by Matt Smith Canine Training or repurpose it without written consent from Matt Smith Canine Training.

  10. Matt Smith Canine Training will not be responsible for the creation of work which in any way contravene any existing Legislation and in particular the Trade Description Act 1968 and the Consumer Credit Act 1974.

  11. Matt Smith Canine Training reserves the right to refuse to provide service or create work at its own discretion.

  12. Matt Smith Canine Training cannot always guarantee to start work immediately.

  13. If no timescale has been agreed for a service Matt Smith Canine Training will not be responsible for any losses to the client if deadline is not met.

  14. Once the work meets the terms of the quotation with its specifications any modifications to the work will be considered an amendment to the contract and charged accordingly.

  15. Amendments to programmes and training may incur an additional charge beyond that of the original invoice.

  16. All amendments must be agreed by both Matt Smith Canine Training and the client.

  17. Amendments may exceed original deadlines agreed by Matt Smith Canine Training and the client.

  18. Training programmes are completed within the agreed timescale– this is confirmed at time of booking.

Cancellation & Termination

​

Matt Smith Canine Training may, by written notice, terminate any agreement at its discretion without prejudice:

  1. If the client fails to pay which has become overdue.

  2. If the client breaches any of the terms of the agreement.

  3. If Matt Smith Canine Training discovers that the client’s use of work produced is unethical misleading or morally corrupt.

  4. If the client’s use is in anyway harmful to Matt Smith Canine Training or its reputation.

  5. The client may cancel the agreement at any time but may be invoiced up to the full amount quoted based on the degree to which the work has been completed and on the extent to which time has been allocated to the project that cannot be effectively used to generate revenue that would be otherwise lost.

  6. The agreement will be deemed as cancelled if there is more than 21 days from the first training or consultation.

  7. No refunds will be issued for breach of agreement. Other requests for refund will be honoured at the discretion of Matt Smith Canine Training.

Payment

​

  1. Matt Smith Canine Training expects payment in full for all bookings. 

  2. Matt Smith Canine Training offer no credit or loan facility for any bookings.

  3. Payment types accepted. Cash, contactless payment, Bank Transfer and/or online payment via Square. Clear-Pay payments are accepted, payments via Clear-Pay are made in full to Matt Smith Canine Training. The client will be responsible for maintaining payments to third party lenders.

  4. For bookings made online, the client shall pay Matt Smith Canine Training the full price of the service requested at the time of booking.

  5. Quotations and/or recommendations for all works valid for 14 days. Matt Smith Canine Training has the right to amend quotes without prejudice or notice after that period.

  6. For bookings made manually and by agreement, the client shall pay Matt Smith Canine Training the full price of the service either at the end of the agreed service date or no less than 7-days upon receipt of invoice. Clients will be invoiced for the service provided electronically with a link to make online payment. Administration fees apply.

  7. Late payment fee of £20.00 will be charged every 7 calendar days the full outstanding fee is not settled.

  8. Any payment returned by the bank or card company will incur £10.00 admin charge as well as any charges made by the bank.

  9. In case collection proves necessary, the client agrees to pay all fees (including all legal fees and court costs) incurred by that process. If for any reason whatsoever Matt Smith Canine Training are unable to provide an agreed product or service in accordance with these terms and conditions our liability shall be limited in its entirety to a proportional refund of any fees paid by, you for the service or product.

  10. All administrative fees to third parties and the time taken to organise will/may be charged to the client irrespective of any quoted amount set out in the quotation with its specifications.

Matt Smith Canine Training’s Liability

​

Matt Smith Canine Training is fully insured by Protectivity Insurance to conduct (up to 6 dogs at any one time):

  • Dog Walking (Service not offered)

  • Dog Grooming (Claw clipping offered only)

  • Dog Training

  • Pet Behaviourist (Services not offered)

  • Pet Minding (Service not offered)

  • Pet Sitting (Service not offered)

  • Pet Transportation (Service not offered)

  1. Matt Smith Canine Training shall have no liability under any circumstance whatsoever to the client for financial loss or loss of profit.

  2. Matt Smith Canine Training will not be held responsible under any circumstances whatsoever to the Client for a lack of time, effort, and circumstances from the work.

  3. In no event will Matt Smith Canine Training be liable to the client or any third party for damages or losses.

  4. Matt Smith Canine Training will not be liable for any loss, injury, or liability to the client.

  5. Handlers and/or owners will always remain responsible for their dogs and are advised to ensure they have adequate pet or household insurance cover for liability in the unlikely event of damage or injury caused by their dog to property or to a third party.

 

Communication

​

  1. Matt Smith Canine Training’s preferred method of communication is by email. However, documents can be sent by traditional post, if no email address is available, this will incur a postal fee to send through reports to the client at the current postal rate and packaging.

  2. A secondary optional mobile telephone method is requested at the time of booking either online or manual.

  3. Matt Smith Canine Training shall not be held responsible for spelling mistakes or typing errors to any documents. Signatures are not required to start a contract; verbal communication, email or other exchanges are legally binding.

 

Copyright

​

  1. All material, both text and images included in documents are the property of Matt Smith Canine Training.

  2. Matt Smith Canine Training holds copyright of all work created.

  3. Matt Smith Canine Training branding must not be used for any promotion or publication either private or commercial, online, audibly, or visually without prior consent.

 

Advice

​

  1. The information and any treatment suggested consists of Matt Smith Canine Training’s personal views and are based on the information given to Matt Smith Canine Training by the client or person responsible for the animal(s) and or Matt Smith Canine Training’s own conclusions resulting from personally gained evidence of the animal and the related behavioural problem.

  2. Treatment plans, for the most part, will not be successful overnight. This requires a good deal of patience. Matt Smith Canine Training cannot guarantee that this will work, as each animal is an individual case, nor is it possible to foresee if another problem may arise because of the treatment. All programs are specific to a certain animal and should not be tried on any other pet, only the animal whose name that appears on the information.

  3. Matt Smith Canine Training encourages clients to contact their veterinary surgeon prior to putting the actions into effect if they are concerned. By booking one of Matt Smith Canine Training’s services, you are agreeing to these Terms and Conditions. Once booked and paid for, there is no refund available.

  4. Matt Smith Canine Training reserves the right to cancel or change an appointment at any time by notice with immediate effect, without cause. By booking you will agree to keep the date and time of the consultations. If changes to the date and/or time need to be altered by you, then 48 hours’ notice will need to be given, otherwise the full fee will be incurred on top of the existing consultation fee.

 

Locations and Dog Requirements

 

  1. You must have insurance and your dog(s) must be microchipped. Matt Smith Canine is not permitted to work with any dog(s) that do not have either or both. 

  2. Upon booking confirmation you agree to Matt Smith Canine Training being able to scan for a microchip or ask for documented proof.

  3. Location to be agreed at the point of booking. 

  4. It is only your own dog(s) Matt Smith Canine Training will be working with, and their vaccinations and wormers are up to date.

  5. You are responsible for your dog at all times. Matt Smith Canine Training cannot accept any responsibility whatsoever, to you, your dog(s) or anyone else because of your dog(s) or otherwise. You must have adequate third-party insurance.

  6. It is strongly recommended that your dog is insured for injury. We cannot be held responsible for any injury which may occur.

  7. We cannot take responsibility for any loss, damage or theft to your vehicle or your property.

  8. The dogs are from the same household. Matt Smith Canine Training allows up to three dogs for any/all one-to-one Practical Training Sessions. Up to six dogs for group Practical Training Sessions.

  9. Children must be accompanied by a responsible adult and always supervised whilst on the premises. Matt Smith Canine Training is authorised to work with minors, a parental/guardian form must be completed prior to any training involving minors.

  10. Conditions of the location agreed at the point of booking will not be the responsibility of Matt Smith Canine Training, appropriate clothing, footwear, and other equipment will be the responsibility of the client.

  11. Hire of privately booked fields will be the responsibility of the client. Hire times must be within the agreed session booking period. 

  12. Provision of dog waste bags will be the responsibility of the client. Picking up and disposal will also be the responsibility of the client. 

  13. All dog(s) must be always supervised.

  14. If the dog, or any dogs that live within the same household, is showing any ill health (coughing, diarrhoea, vomiting, general lethargy etc) you will cancel the session. If within the permitted cancellation period this can be rearranged, or the booking will be cancelled, and full payment made. Hire of any privately booked fields will not be reimbursed by Matt Smith Canine Training. 

  15. Notification of female dogs in season must be made to Matt Smith Canine Training at the point of booking. Bookings may be rearranged without notice.

  16. Please note that all training equipment used during training that is not provided by Matt Smith Canine Training, must be inspected and the safe and correct use must be demonstrated - this includes but is not limited to: electric collars; spray collars; prong collars, rattle cans and corrector spray. 

  17. We reserve the right to ask you to terminate your session and or forfeit any future bookings if we have reason to believe that you have/are mistreating any dog, before or during the Phased Training period. Matt Smith Canine Training will also make a full report to the Police and local authorities. 

  18. Each session starts on the hour and/or half hour and last for 60 minutes.  

  19. All bookings are made in advance, all prepayment deals are non-refundable and sessions subject to availability.

  20. If you are late for your appointment, you will not be permitted additional time. The session booking agreed is binding and you will lose the time you are late.

  21. If you are unable to take the booking, for any reason, you will cancel with at least 24 hours’ notice to allow the session to be freed up for others.
